ChildLife (“we”, “us” or “company”) is committed to respecting your personal privacy and recognizes that you care how the information you provide to us is used and how we treat that information. This “Privacy Policy” has been established to inform you of our practices for collecting, processing, using, maintaining, protecting, and disclosing information that we obtain from you in connection with your use of the ChildLife website (the “Website”) or other services and applications that link to this Privacy Policy (the Website and other services and applications, collectively, the “Services”).

This Privacy Policy describes how that information is collected, used, and shared. We also work with affiliates, which include other entities directly or indirectly controlled by, or under common control with, us (“Affiliates”). Information collected on or through the Website may be collected by ChildLife, Affiliates, by third-party service providers, and first-party advertisement serving vendors acting on behalf of us or our Affiliates, and/or our business partners, as further described below. By accessing the Website, you agree to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the Services.

2. What is Personally Identifiable Information?

For purposes of this Privacy Policy, personally identifiable information (“PII”) is information about an identifiable individual, which may include name, address, email address, payment card information, and birth date. It does not include aggregated information that does not allow you to be identified.

We will only collect PII that you choose to provide via the Services or in accordance with this Privacy Policy.   • No Discrimination: We will not discriminate against you for exercising your rights under the CCPA, including by denying service, suggesting that you will receive, or charging, different rates for services or suggesting that you will receive, or providing, a different level or quality of service to you.

We will contact you to confirm receipt of your request under the CCPA and request any additional information necessary to verify your request, including, as applicable, your name, email address, telephone number, address, and social media account identifier or handle. We verify requests by matching information provided in connection with your request to information contained in our records. Depending on the sensitivity of the request and the varying levels of risk in responding to such requests (for example, the risk of responding to fraudulent or malicious requests), we may request further information in order to verify your request. You may designate an authorized agent to make a request under the CCPA on your behalf, provided that you provide a signed agreement verifying such authorized agent’s authority to make requests on your behalf, and we may verify such authorized person’s identity using the procedures above.

Our goal is to respond to any verifiable consumer request within forty-five (45) days of our receipt of such request, but in certain cases, additional time might be required. 7. Use of Information

We may use information that we collect about you or that you provide to us, including any PII:

9.  Transfer of PII

The PII that we collect from you may be transferred to, and stored at, a destination outside of your country of residence (which may not provide the same level of protection as your country of residence). It may also be processed by staff operating outside of your country of residence, who work for us or for one of our service providers. By submitting your PII, you consent to this transfer, storing, and processing.

10.  Children and Privacy

This Website is a general audience website and is not intended for use by children. We will never knowingly request PII from anyone under the age of 18 without prior verifiable parental consent when legally required. If you are under the age of 18, you should not provide any PII to us and you should use this Website only with the involvement of a parent or guardian. If you are a parent or guardian of a child under the age of 18 and suspect he/she has provided PII on or through this Website, please contact us as set forth below. If we become aware that a customer is under the age of 18 and has registered without the legally required prior verifiable parental consent, we will remove his or her personally identifiable registration information from our files.

We take security seriously and we take precautions to keep your PII secure. We have put in place appropriate physical, electronic, and managerial procedures to safeguard the information we collect. There are several ways in which you can tell us whether or not you want to receive promotional communications from us or “opt-out” of certain of our uses of your information.

  • Affiliate and Third-Party Communications: If you wish to opt out of receiving marketing and advertising communications from our Affiliates or other third parties, you must follow the opt-out instructions in each Affiliate’s or other third party’s communication or privacy policy.

We will retain your information for as long as your account is active or as needed to provide you the Services.

Additionally, you have the following rights and choices in providing your information for promotional proposes and choosing how we communicate with you:

  • You may ask us to delete your information and withdraw your consent at any time by contacting us at hello@childlifenutrition.com.
  • You may opt out of receiving email marketing promotions by clicking on the “Unsubscribe” link at the bottom of any emails you receive. To the extent you are receiving text messages from us, you may opt out of receiving text messaging by replying to any message we send you with the word “STOP”. To the extent you receive notifications from any of our applications, you may opt out of receiving push notifications on your mobile device through your account and device settings.
  • If you are unable to remove the content you posted on our Website, you can request that we help you take down such publicly-posted content by contacting us at hello@childlifenutrition.com. Please note that any information you post to any public posting area is available to anyone with Internet access. If you don’t want people to know your email address, for example, don’t include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN PUBLIC POSTING AREAS.

Please note that while text messaging opt out/unsubscribe requests are processed immediately upon our receipt, we are not responsible for any carrier delays. Carriers are not liable for delayed or undelivered messages. Additionally, please allow up to 10 business days to process marketing email opt out/unsubscribe requests. If you make a purchase through our Website or stores, you may opt back in to marketing communications from us until you opt out/unsubscribe once again. You may opt back in to receiving text messaging by providing us with explicit permission to send you text messages during the order checkout or other sign-up process.

Notwithstanding the above, we may need to retain limited information about you in order to fulfill any order requests made by you, for business, tax, retention and litigation purposes or to fulfill other legal or regulatory obligations. As such, we may still continue to send you non-marketing communications by email, such as transactional or operational communications, even if you have opted out/unsubscribed from our marketing communications.

When you make a purchase, we ask you to provide payment information, which may include payment card information (such as credit card number, type, and expiration date), billing address, and shipping address. Our third-party payment management companies, which are required by credit card issuers to meet specific security requirements, will collect, store, and process your credit card and other payment information on our behalf using industry-standard security measures.

15. Social Media Platforms

The Services may provide you with the ability to register, log into, “like” or otherwise interact with your social media services, including Facebook, Instagram, Twitter, Pinterest, and other social media services. These features may enable integration and/or access to your social media accounts. We do not control these social media services or your profiles on these services, and we do not establish privacy settings or rules for how your PII on those services will be used. You agree that we are not responsible for any acts or omissions by these social media service providers.

We may amend and update this Privacy Policy from time to time. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter. The date the Privacy Policy was last revised is identified at the top of the page. Your continued access of the Website following the posting of changes to this Privacy Policy constitutes your acceptance and agreement to the changes.
